I would have INCREASED his jail sentence for using child porn to try to maliciously sabotage someone else. I consider that worse than downloading it for your own use.
I would send a tough message to people who engage in such behavior. I think punishment should be worse when you try to make an innocent person take blame for something you did. If I were the judge I would have made his defense backfire.
